Filing a divorce "pro se" means representing yourself without a lawyer, but
POWELL LAW OFFICE will give you professional assistance to complete your
divorce papers the right way, the first time.  It is inexpensive, but requires some
effort on your part.  It is appropriate only when there are NO issues between you
and your spouse regarding children, child support, property, or alimony. If your
spouse decides to contest or disagree with any issue, this option will be difficult for
a non-lawyer to accomplish.  It is, however, a very good divorce option if both
parties want the divorce, there are no children or property issues, and you feel
comfortable handling the procedure yourself.  

POWELL LAW OFFICE will prepare the divorce documents, and give you simple
directions on how to file and receive your divorce decree, but will not enter as
attorney of record in your case under this option.  

How does it work?

After ordering this service, email POWELL LAW OFFICE with your name and
telephone number.  We will contact you for an interview to prepare your divorce.  
An attorney from POWELL LAW OFFICE will prepare the documents needed for
an uncontested pro se divorce.  You, as your own attorney "pro se", would be
responsible for filing the paperwork with your county's Clerk of Court, for paying
the Clerk's filing fees, and for contacting the Clerk of Court to arrange for the
Judge in your county to sign the divorce decree after the 60-day waiting period.

At the interview, you will be asked to submit a document acknowledging  the
services you have purchased.  You will also be asked to provide the information
needed to complete your divorce paperwork.    

What if my divorce becomes contested after I've tried a do-it-yourself filingr?

You can upgrade to another Option with POWELL LAW OFFICE, and we will give
you credit (not a refund) for upgrading your service requirements.  If you choose to
go to a different law firm, the pro se filings will remain your property.

OPTION 2:  UNCONTESTED DIVORCE
- No children; no child support or property division needed

This option is used in divorce cases where no contested issues exist between the
parties, but the client does not want to handle the court process themselves.  
POWELL LAW OFFICE represents the party who pays for the services.  The other
party is advised to seek the advice of independent counsel, but is not required to do
so.  It provides additional consultation services whether you are the Plaintiff filing
for the divorce, or, have been served with divorce papers and you are the
Defendant.  POWELL LAW OFFICE prepares all of the necessary documents, and
appears in court for the parties.  This option requires that the parties have no
children between them.  

How does it work?

After ordering this service, email POWELL LAW OFFICE with your name and
telephone number.  We will contact you for an interview to prepare your divorce.   
An attorney from POWELL LAW OFFICE will prepare the documents needed for
an uncontested divorce.  After receiving your signed documents, we will file your
divorce with the Court.  

You are responsible for getting the signed documents back to the law firm before
the divorce can be filed.  There is a 60-day waiting period required by South
Dakota Law before a Decree of Divorce can be signed by a Judge.  At the end of
that time period, POWELL LAW OFFICE will obtain your finalized divorce decree,
and give notice and copies to both parties.  Neither spouse has to appear in court.  
The law office appears in Court for purposes of having the  Decree of Divorce
finalized.

At your attorney-client interview, you will be asked to submit a document
acknowledging  the services you have purchased.  You will also be asked to provide
the information needed to complete your divorce paperwork.    

If you need to upgrade your services, we will give you credit (not a refund) for
upgrading your service requirements.  If you choose to go to a different law firm,
the prepared documents will remain your property.

OPTION 3:  UNCONTESTED DIVORCE

This Option works exactly the same way as Option 2, except, additional work is
required to calculate child support and to prepare a more detailed Settlement
Agreement. Each spouse must be in agreement as to custody, child support, and
property division.  At your attorney-client interview, you will be asked to provide a
list of property that each person is to keep for themselves, and information about
the child or children.  This information can be sent to our office by email, or
gathered during the attorney-client interview.  Your attorney will ask for specific
financial and asset information so that child support and property division can be
incorporated in to your Marital Settlement Agreement.
